Standing in San Francisco

We have spent upwards of $20,000 on bus ads in San Francisco. San Francisco city officials have turned over all the revenue generated from our ad campaigns to the Human Rights Commission to "study discrimination against Muslims."

Wasting taxpayer dollars in so craven a manner violates the public trust. But more importantly, this is a violation of the establishment clause. It is showing preference by the U.S. government of one religion over another. San Francisco is giving  "preferential"
"accommodation" to Muslims to benefit one religion over all others. How are these dollars being spent? We want an accounting.

We wish to file a lawsuit against the city of San Francisco for violation of the establishment clause. I need someone who lives in San Francisco and pays taxes to San Francisco. I need someone with standing in San Francisco to act as plaintiff in our case.

I hope you sue San Francisco bankrupt on precisely the grounds you say — judicially preferring the Satanic muslim “religion” over our own advanced, traditional, great, civilized American Judeo-Christian culture.
And at least give the diseased Ninth Circuit Court of Appeals the chance to prove to all Americans whether it is a sharia organ or not.

Bravo! And is there any way to attack the selective disclaimer at the bottom of your ads? Why do you have to bear the transit authority’s freight, and why do other advertisers not have to? Shouldn’t you get a discount?

I hope you do sue, as the City will win and you will likely have to pay a fee for having filed a totally nonsensical and unfounded lawsuit. Studying discrimination is not establishing a religion. Not even close.

Supreme Court interpretation of the Establishment Clause does not begin until 1947 in Everson v Board of Education. Voting 5 to 4, the Court upheld a state law that reimbursed parents for the cost of busing their children to parochial schools. (It was clear from the various opinions in Everson that if the state had reimbursed the parochial schools for the cost of providing the transportation, that it would have been found to violate the Establishment Clause.) Although in his majority opinion Justice Black wrote of the “wall of separation” that the Constitution maintains between church and state, Black viewed the aid in question of serving the state’s secular interest in getting kids “safely and expeditiously” to schools. The case is noteworthy for its extensive discussion of the purposes of the Establishment Clause, and for the fact that all nine justices agree that the clause was intended to do far more than merely prohibit the establishment of a state religion.

In the words of the Court in Everson:
“The establishment of religion clause means at least this: Neither a state nor the federal government may set up a church. Neither can pass laws that aid one religion, aid all religions, or prefer one religion over another. Neither can force a person to go to or to remain away from church against his will or force him to profess a belief or disbelief in any religion… . Neither a state or the federal government may, openly or secretly, participate in the affairs of any religious organizations or groups and vice versa. In the words of Jefferson, the clause against establishment of religion by law was intended to erect ‘a wall of separation between church and state.’”
