Court partly reinstates Trump travel ban, fall arguments set

WASHINGTON (AP) — The Supreme Court is letting a limited version of the Trump administration ban on travel from six mostly Muslim countries to take effect, a victory for President Donald Trump in the biggest legal controversy of his young presidency.
The court said Monday the ban on visitors from Iran, Libya, Somalia, Sudan, Syria and Yemen could be enforced as long as they lack a “credible claim of a bona fide relationship with a person or entity in the United States.” The justices will hear arguments in the case in October.
Trump said last week that the ban would take effect 72 hours after being cleared by courts.
The Trump administration said the 90-day ban was needed to allow an internal review of the screening procedures for visa applicants from those countries. That review should be complete before Oct. 2, the first day the justices could hear arguments in their new term.
A 120-ban on refugees also is being allowed to take effect on a limited basis.
Three of the court’s conservative justices said they would have let the complete bans take effect.
Justice Clarence Thomas, joined by Justices Samuel Alito and Neil Gorsuch, said the government has shown it is likely to succeed on the merits of the case, and that it will suffer irreparable harm with any interference. Thomas said the government’s interest in preserving national security outweighs any hardship to people denied entry into the country.
Two federal appeals courts had blocked the travel policy, which Trump announced a week after he took office in January and revised in March after setbacks in court.
The 4th U.S. Circuit Court of Appeals in Richmond, Virginia, said the ban was “rooted in religious animus” toward Muslims and pointed to Trump’s campaign promise to impose a ban on Muslims entering the country as well as tweets and remarks he has made since becoming president.
The San Francisco-based 9th U.S. Circuit Court of Appeals said the travel policy does not comply with federal immigration law, including a prohibition on nationality-based discrimination. That court also put a hold on separate aspects of the policy that would keep all refugees out of the United States for 120 days and cut by more than half, from 110,000 to 50,000, the cap on refugees in the current government spending year that ends September 30.
Trump’s first executive order on travel applied to travelers from the six countries as well as Iraq, and took effect immediately, causing chaos and panic at airports over the last weekend in January as the Homeland Security Department scrambled to figure out who the order covered and how it was to be implemented.
A federal judge blocked it eight days later, an order that was upheld by a 9th circuit panel. Rather than pursue an appeal, the administration said it would revise the policy.

This brings into stark relief how important the battle for the judiciary is. The ninth circuit will be happy to lead the US to the Swedish model (see a post on this site yesterday for a description of how Sweden appears to be dissolving)

Yes! A win for the American people. It is constitutionally correct that the President has the right to do this and no court had the right to block him. We are back to following the rule of law which is good for America
Real Americans took our country back from globalist elite! We wanted our jobs and our nation back! Our healthcare was too expensive. Mine is $700/month now (thanks to Obamacare). My car insurance is still $25 per month (from Insurance Panda), but what are the Democrats plans for that? If you look at Democrat strongholds like Detroit and New Orleans, car insurance will run you $300+ per month!

I’m not sure that there is so much to celebrate here. Clearly, Alito, Thomas and Gorsuch will side with the President when the merits of the case are heard in October. Just as clearly, Roberts and Kennedy may not. Why leave the injunctions in place at all? Few Executive prerogatives are as explicit as the one surrounding immigration, but now it seems that Justice Roberts has added his own personal interpretation, and a “bona fide relationship with a person or entity in the United States” – which is mentioned exactly nowhere in the statute – is suddenly some kind of litmus test. Roberts is legislating with this ruling, and it doesn’t bode well.
Exactly right. Roberts proved himself to be a libtard idiot and statist when he said Oblabber care was a tax when, in fact, it did not originate in the house as required for taxes.
The ace in the hole for President Trump that has not even been hinted so far is that all the countries listed in the ban are classed as failed states with the exception of Iran, and it wouldn’t take much for it to be as well.

This is not a good decision. Thomas, Alito and Gorsuch got it right. The rest of the court created and exception out of thin air. They did not rule on the law, they just made it up.

It is a miserable compromise because this decision compromised the constitutional authority of the President to achieve this large majority, opening the doors to endless motions and suits by leftist attorneys on a case by case basis regarding the special interests exceptions. And after all that we have been less protected for five months. Trump is still limited by the advice of those around him because evidently he believes that he must subject his constitutional authority to what is in truth judicial interference with his policy decisions that are solely within his authority.

With an unanimous ruling by the SCOTUS do not look for an “October surprise” when arguments are heard in the case. What was always known, except to the lower courts, is that the ban complies in every aspect with public law as contained in 8 US Code, Section 1182, entitled “Inadmissible Aliens”.

Title 8, Chapter 12, US Code 1182:
(f) Suspension of entry or imposition of restrictions by President
Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate. Whenever the Attorney General finds that a commercial airline has failed to comply with regulations of the Attorney General relating to requirements of airlines for the detection of fraudulent documents used by passengers traveling to the United States (including the training of personnel in such detection), the Attorney General may suspend the entry of some or all aliens transported to the United States by such airline.
This is current law. He doesn’t need Congress or the SCOTUS to say it’s OK.
