Supreme Court Expedites Trump’s Petition on Executive Order Case

Story continues below advertisementD.C.—The Supreme Court took the rare step on Friday of expediting consideration of a major case, rapidly accelerating the schedule for reviewing the Fourth Circuit’s blocking of President Donald Trump’s travel ban executive order.
President Trump issued Executive Order 13780 (EO) on March 6, Section 2(c) of which temporarily restricted travel from six Muslim-majority countries associated with terrorism while the United States developed new vetting procedures to keep the nation safe.
Immigration activists sued, along with several immigrants and their families. A liberal federal district judge in Maryland granted a preliminary injunction blocking Section 2(c) of the EO. The U.S. Court of Appeals for the Fourth Circuit then affirmed the trial court’s injunction in a 10-3 decision, ruling that the EO violated the Constitution’s Establishment Clause, and taking the almost unheard-of step of all the court’s judges hearing the case, instead of sending it to a three-judge panel.The U.S. Department of Justice (DOJ) filed a petition for review at the Supreme Court on Thursday. Under the Court’s rules, a response from the plaintiffs would be due July 3. By that time the Court would be on recess for the summer, meaning that the justices would vote at the Court’s annual pre-Term conference, which will take place on September 25, on whether to take the case. That would typically mean hearing arguments in December or January, with a final decision coming down in early or mid-2018.
Acting Solicitor General Jeff Wall at DOJ also asked Chief Justice John Roberts (who supervises the Fourth Circuit) to stay the appellate court’s decision until the justices can decide the matter.
On Friday, the Supreme Court rapidly expedited everything. The ACLU—which represents the plaintiffs—have been ordered to file their response by 3:00 p.m. on Monday, June 12. The ACLU lawyers must also respond to DOJ’s application for a stay by that time.
The Court could conceivably then vote immediately on whether to take the case, or anytime shortly thereafter. Under a normal briefing schedule, the Court would then hear arguments in October, and issue a decision by the end of 2017.
It’s also possible that the Court could accelerate briefing on an emergency basis, then hold arguments over the summer, or possibly even in June before recessing for the summer. The Court could make clear by the week of June 12 which course it is pursuing.
The case is Trump v. International Refugee Assistance Project, No. 16-1436.

Isn’t it wonderful that it takes literally days for an activist “judge” to stop an EO that is crucial to the safety of the country and yet takes MONTH for SCOTUS to overturn that idiotic and unconstitutional ruling… and in the meantime we’re allowing God only knows who into OUR country with no proper vetting! It’s well past time to get rid of these activist judicial circuit courts and judges!

The president has the right to ignore illegal court orders where the subject matter is solely and exclusively within the powers of the president such as immigration administration.
President Lincoln ignored many federal court orders that attempted to block his powers as commander and chief of the armed forces during the Civil War.
Same with president Andrew Jackson using his war powers to remove the Indians from the Southeast USA.

We can only hope that SCOTUS, recognizing that the terrorists are all Islamic believers who justify their barbaric conduct thru the so-called unholy teachings and promotions of their so-called “religious books,” superimposed on what has recently become an increase in their foul and horrible conduct as a result of the fact that they are being beaten down in Iraq and Syria, should result in the Court expediting the hearing on the issues posed within the EO in question. Our judiciary cannot sit on this issue. It has the power under the exigent circumstances existing to push the issue to an immediate conclusion. The cases have been briefed extensively thru the lower courts. Neither side needs additional time. It should be decided before the end of June, as I believe we better act quickly since American lives are on the line. Simply stated, with what we know about the terrorists, they are all Islamic believers, who reject Life, and accept Death under the false notion that they will benefit in the afterlife, though most reasonable people would not accept such a conclusion, and therefore are extremely dangerous, and should result in a closing of our doors to these vile people.

Yes – SCOTUS need not foot-drag on this. With a full house of nine members, it should be clear that decisive, swift action is needed now. Let’s see how long they drag their feet if they, or a family member, falls victim to a criminal assault/murder by these invaders of America.

I urge EVERYONE on here to write to/call/E Mail your government representatives and governors and the Supreme Court and tell them to:
A) Support the travel-ban.
B) Instead of allowing massive, unsafe migration, support Middle East safe-zones. This way real refugees can be helped, and western countries don’t have to put their citizens at risk.

How do people living in the Third World have First Amendment protections?
LAW SCHOOL 101: First Amendment protections apply only and exclusively to US citizens and residents of the USA. People living in the Third World (or any other part of the world) who are not US c:itizens do not have First Amendment or any other Constitutional protections.
The 10 Fourth Circuit judges who invalidated the executive order need to be impeached for judicial activism or incompetence.
LAW SCHOOL 102: People living in the Third World don’t have any “standing” to sue the US president in federal court.
LAW SCHOOL 103: Frivilous law suits by the ACLU, CAIR, etc. require crippling sanctions be imposed by the SCOTUS.
LAW SCHOOL 104: Islam is not entitled to US Constitutional protections because it does not constitute a “religion” within the meaning of the First Amendment. The First Amendment was referring to Christian religions exclusively. Islam is a totalitarian political ideology like Communism and Nazism and thus, is not a religion within the meaning of the First Amendment.
