Texas Demands Feds: Stop With DACA, or 10 States Will Sue

Tough-talking Texas, via its attorney general, took the lead in a 10-state letter to the federal government to warn that if the Barack Obama-era DACA — Deferred Action for Childhood Arrivals — doesn’t come to an immediate end, they’ll sue.

Among the states joining the threat: Alabama, Arkansas, Idaho, Louisana, Kansas, Nebraska, South Carolina, Tennessee, and West Virginia — and of course, Texas.

Not all are hoping the President Donald Trump administration will put a halt to DACA.

They gave the President Donald Trump administration a deadline of September 5 to stop issuing and granting new DACA applications.

“The attorneys general said if new DACA permits and renewals were ended by the deadline, they’d dismiss their lawsuit challenging programs former President Barack Obama tried to create with a 2015 executive action. The programs would have allowed millions more immigrants illegally here eligible to remain and to work.

“If by September 5, 2017, the Executive Branch agrees to … not renew or issue any DACA or expanded DACA permits in the future, the the plaintiffs … will voluntarily dismiss their lawsuit currently pending in the Southern District of Texas. Otherwise the complaint in that case will be amended to challenge both the DACA program and the remaining expanded DACA permits,” the letter states.

But, Texas and 25 other states challenged Obama’s executive action in a lawsuit against the federal government and court action kept them from going into effect. A trial on the constitutionality of Obama’s action had not been held.

When Obama’s term ended and President Donald Trump took over, the Trump administration became the defendant in the lawsuit. The administration said it would no longer defend the programs and rescinded a memo instituting them on June 15 because Trump did not support Obama’s 2015 executive action.

Texas and the other state officials that signed the letter are refusing to follow suit and drop the challenge. State officials from several of the states in the lawsuit did not sign the letter.”

The left, as you can imagine, is not sitting quietly.

Thomas Saenz, the president and general counsel of Mexican American Legal Defense and Educational Fund, said his group has condemned the pressing of states’ attorneys general to quit the DACA program, and vowed to go to court himself if feds don’t continue issuing applications.

Again, from NBC:

“He referred to their actions as “xenophobia” and “mean-spirited stupidity” and said the state officials who signed the letter have “etched their names in ignominy.”

“MALDEF urges the president not to cave in to the toothless threat in today’s Texas letter. Presidential authority does constitutionally extend to protecting DACA recipients, whom the president has repeatedly declared worthy of protection. We urge the president to fight to vindicate that authority,” Saenz said.

Saenz said MALDEF, which intervened in the case, will move to dismiss it.”

DACA was illegal from the outset for the same reason the Fifth Circuit Court of Appeals found DAPA illegal.

DACA kids passed a background check before they received legal work
permit in USA. These young people came in USA as minors,many finished
college! How stupid and inhumane will be to hurt good young people who
can be a great asset for America. I repeat myself, these young people
are already checked and they are not criminals or bad people! By the way
I am American Citizen! Those who wish to end DACA guess what! One day
you will be hit so hard so you will never forget that life is a game
with boomerangs and all you wish to others will come back to you! Nobody
escapes the law of karma or in simple words said what you sow, you
reap!

These wonderful kids, now adults, can return home with their education and make home great.

If they want to enter again they can get in the front line that everyone one else has to use, with the ten year delay penalty prescribed by law.

Its time to scrap this law. It becomes a Loophole that encourages parents from sending children across while real refugees are denied.

This ball got rolling in the Reagan era – 1986-87, when 2 million illegals were granted amnesty for a promise that Congress would close the border and enforce immigration laws. It didn’t happen then, so America will have to pay hell to have it happen now.

Good, law fare is what they want, then law fare is what they will get. As reason and common sense are no longer in play with anything involving democrats, it will be necessary to legally impose fair solutions for everyone, not just illegal immigrants, and financially punish those who violate the law. It is time to remind mexicans that American make the decisions in America.

How much proof do we need?
We have spent $6+ trillion trying to “fix”
the unfixable Middle East while the country next door has degenerated to the #2 most deadly country in the world behind Syria.
And the criminals just ride, wade or walk into our nation.
Who hires these policy idiots?
Build the wall-invade Mexico and exterminate the cartels.
