Sgt. Derrick Miller: He Fought For Them, But They Won’t Fight For Him

As I read this article, I am reminded of many meetings with Maryland reps up on the hill, spanning 3 years, to secure relief/release for Sgt. Derrick Miller from Leavenworth. Derrick, unlike others in Leavenworth, has NEVER received a reduction in his life sentence.

Sgt. Miller’s mother, Renee Myers, has endured the ultimate run around like I’ve never seen from the representatives in her home state of Maryland. She also has endured insult, and one particular meeting comes to my mind.

In a meeting with Chris Schloesser, an assistant to Congresswoman Donna Edwards, I asked Mr. Schloesser what he had to say to this mother, who cries herself to sleep at night for her incarcerated Soldier Son, while President Obama releases terrorists out of Gitmo, right and left. His reply I will never forget: in a bold and horribly insensitive manner, he looked at us and loudly and emphatically stated “BUT WE’RE TRYING TO CLOSE GITMO!” That was the end of the meeting for me. Mr. Schloesser did promise Derrick’s mother he would look into helping as his brother was a bigwig in the 101st. She never heard from Schloesser again.

We have attempted to put together a Maryland Delegation, truly essential in efforts to secure relief/reduction in Sgt. Miller’s life sentence, but to no avail. Based on personal experience, and three years and many trips to DC later, I know one thing for sure, it is true the “Democrats can’t hide their contempt for the military,” and I can assure you that in Maryland, they sure don’t even try to hide it!

We have since set out to secure support for Derrick among Republicans, and I believe we may finally get help. We endured the run around for three wasted years that Derrick and his children will never get back. We did this with earnest because it is customary and essential to secure support for a Soldier from reps in their home state in order to affect status in their conviction. We were NEVER able to get all Maryland Reps to come together and fight for their Son from Maryland.

Veteran Charlie Rangel wrote one meaningful letter on behalf of his Brother. He requested a clemency hearing for Derrick and one was granted. Clemency was denied. Congressman Rangel is from New York and we are grateful for his letter.

Congressman Cummings and Congressman Chris Van Hollen wrote pathetic letters. Van Hollen asked the Army:

“Given the complicated circumstances surrounding Sergeant Miller’s conviction, I am requesting your consideration of whether a reduction in length of sentence is warranted.”

Wow, that’s some fight there by former Congressman Van Hollen to secure relief for this Maryland Son and constituent! I bet he never wore a uniform, and thank God for that!

Congressman Cummings wrote a letter and with no answer received after 6 months, his office wasn’t sure what to do next?!! Sure seems to me when a Congressman doesn’t get a response from the Army within 6 weeks, follow-up would be in short order, IF one is truly engaged in fighting for a constituent!

I find it disgusting and heartbreaking that representatives who enjoy precious freedom and safety provided to them by our military will not fight for a Soldier as he fought for them!

For the record, shame on any lowlife who would fight for the release of terrorists yet remain silent as an American Son rots in Leavenworth, all because he did his best to protect his Brothers and himself!

How does a lowlife sleep at night after boldly shoving his defense to release terrorists in the face of a grieving mother whose very son risked his life to keep the lowlife free and safe?!!!!!

I think the answer to that question is on full display by the Democrat’s outrage to our President honoring a War Hero and his widow. Honoring the sacrifices made by our military is abhorrent to them. You see, they celebrate with a Rose Garden ceremony, the homecoming of a traitor, Bowe Bergdahl, swapped for 5 of the worst of the worst terrorists!

And let’s not forget this: It seems if you are Hillary Clinton, you can blame reckless decisions that result in the deaths of 4 brave American Sons in Benghazi on the “fog of war,” but a good Soldier like Sgt. Derrick Miller, who willingly deployed 3 times to the horrendously dangerous “win their hearts and minds” battlefield of Afghanistan, gets slammed away for life for protecting himself and his Brothers. This good Soldier isn’t afforded the “fog of war” defense!  

If you live in the state of Maryland, please pick up the phone and ask your representatives why there is not a Maryland Delegation supporting mercy and a reduction in sentence for their brave Maryland Son, Sgt. Miller! Let them know that he, unlike Hillary Clinton, was literally boots on the ground operating in the real “fog of war!”

Thanks for the link. Read this and weep for Derrick and others. the rules of engagement must be changed immediately and all those in Leavenworth imprisoned for defending themselves must be set free. Go to Free Derrick Miller.org and help.

Thank you! What a poorly written story this was.

And wow, why is this the first time I am hearing of this horrible injustice done to this man?! Barry was all about releasing real criminals and terrorists, but this soldier gets his life wasted and stolen from him and his family for defending himself and doing his job?!

This is a national disgrace! What can we do?

I just found this report now, a year or so late. I received an email from UAP, asking for donations to help this soldier, and put his name in google and found this website. I clicked on your above link, and of course it has been taken down. Anything or anyone that incriminates the powers that be, disappear.

The Republicans have a lot of democrat crimes to clean up, it is time to remove soldiers from jail, where they were sent on lies and treachery from the democrats. Replace every wrongful incarcerated soldier with ten democrat politicians.

So how did that unconstitutional UCMJ System work out for him…………Next time anyone ever believes the UCMJ is a fair, constitutional legal system at all is high on the opium the Afghans are growing……..The career active duty military bureaucrat jury obviously based their decision on bias and possibly because he was a National Guard member……What you want to bet not one person on the panel was a National Guard or Army Reserve member……that is not a jury of your peers…..His commander was weak to have let it get that far and the National Guard Bureau was negligent in not interfering or stopping the Court Martial…..The Active Military has to request from the National Guard for authorization to proceed with a Court Martial…….But National Guard is a bunch of cowards and let the Active components railroad soliders through their rogue UCMJ System…….Many times the Active Duty UCMJ make it appear they contacted the National Guard Bureau when prosecuting an ARNG soldier when actually they never do….Lady Liberty is no longer blind, but a whore to personal agendas……….

From what I read about this case, is that sgt Miller confronted an iSSlamofascist snooping inside his defense perimeter and when he confronted him the iSSlamofascist tried to wrestle a pistol from sgt Miller and in the struggle got shot and killed! Hour later sgt. Miller unit was attacked and sgt. Miller and his soldiers repelled an attack without single American life being lost! This man deserves an commendation, medal and promotion not a cell in Leavenworth.The whole conviction is based ona SINGLE testimony from a soldier who had a long time running with sgt Miller. No other soldier from his unit backed this testimony.

SELF DEFENSE GETS SGT DERRICK MILLER LIFE IN LEAVENWORTH FOR KILLING AFGHAN INSURGENT

In September 2010, twenty-eight year old Sgt. Derrick Miller, of Hagerstown, Maryland, took part in a combat mission in an area of Afghanistan known to be a Taliban stronghold. An Afghan national who had penetrated a defense perimeter set up by the US Army was brought to Sgt. Miller’s attention by one of the soldiers under his command. This soldier recognized the man from a security checkpoint one day prior. He positively identified him as the driver of a truck which Miller’s security detachment had searched. That search revealed the vehicle was transporting armed combatants to a nearby firefight. Derrick’s men were, at that time, instructed to let the vehicle pass because of instructions handed down by his superiors in command at the time.

The Afghan man appeared to be gathering information, thus portraying suspicious behavior, ultimately leading to Sgt. Miller being sent to question him. At this time he was already confirmed to be an enemy combatant.

The questioning took place in an open area with another soldier and an Afghan interpreter present. During questioning, Sgt. Miller asked the man why he was within the perimeter. As the man began to speak, his story changed, not once, but twice. He originally claimed to be there to fix a power line that was down. Later he claimed he was there to fix a water pump.

Originally he was seen accompanied by two men whom he claimed to be his sons and helpers. However, both of these men left the perimeter without performing any work, and going separate directions to their village. These men were not present during Sgt. Miller’s questioning. While questioning the insurgent things began to get heated. The Afghan insurgent attempted to grab Sgt. Miller’s weapon, ultimately leading to him being shot and killed in the struggle.

The military has since identified the deceased as Atta Mohammed, but his name was not used in court.

The two men who escaped were later believed to have been carrying back detailed information to the insurgents with details as to how to most effectively attack. They had been inside the perimeter for hours, thus giving them ample time to scope things out and pass that information up the chain of command. All of the details of what took place that day, and within those few hours, were all confirmed and testified by the Afghan interpreter.

Sgt. Miller’s unit was attacked on three sides by Afghan insurgents within 45 minutes of the questioning and death of the Afghan insurgent. In order for them to have attacked in the manner in which they did, someone would’ve had to have reconnoitered their position very closely, soldiers testified during Sgt. Miller’s trial. There is no doubt that the Afghan insurgent had been doing just that. The incident that happened between Sgt. Miller and this man, had forced their entire unit into full alert/100% security, which ultimately had prepared them for the attack just 45 minutes later. This was also testified during Sgt. Miller’s trial.

No American lives were lost that day due to Sgt. Miller’s actions.

Prosecuting attorney Major Matt Calarco claimed Miller’s actions weren’t in line with military protocol, painting him as a murderer instead of a soldier defending himself and his unit.

Specialist Charles Miller, an eyewitness, Guardsman, and owner of the firearm that was eventually used to kill the combatant, testified that he had heard Miller threatening to kill the man if he didn’t tell the truth. He also testified that Mr Miller straddled the man, who was lying on his back “in the latrine,” before shooting him in the head.

But during an Article 32 hearing, which is similar to a civilian grand jury, Spc. Miller testified that Sgt. Miller was a “squared away” soldier who acted “reasonably in pressure situations.”

“I wouldn’t question his judgment if he believed the use of deadly force was necessary,” Charles Miller said.

In addition to the eyewitness testimony of Charles Miller, all five of the other soldiers who testified, including his commanding officer, described Derrick Miller as a model soldier:

“I observed him on a daily basis,” 1st Lt. Joseph R. Costello said. “In my 18 years of service, Sgt. Miller was one of the best soldiers I had. In combat, he displays excellent judgment.”

Derrick Miller was found guilty of premeditated murder and sentenced to life in Leavenworth prison. After the verdict, Mr Miller’s lawyers said they would appeal for clemency.

Miller’s deployment to Afghanistan was his third in four years. He earlier served two tours of duty in Iraq.

“Sgt. Miller believes, despite his conviction and sentence of life in prison for the murder of this Afghan insurgent, that he was acting solely in self-defense and with sound judgment.”
