Obama-appointed judge in Hawaii blocks Trump’s new travel ban

162

[the_ad id=”87125″]

The people elected President Trump because he promised to enact these very policies. How is it that some autocratic leftwing judge in Hawaii can undermine the will of the American people and issue a nationwide halt to the President’s urgently needed immigration order?

The job of a judge is to enforce the law (whether he likes it or not). It is not to make law, legislate or be an activist from the bench. Our enemies will exploit the actions of the enemies among us who care nothing of our security and only of their failed ideology.

This is who and what the left is. They refuse to accept plurality or the results of a fair and free election. They impose their will by edict. They have destroyed this country, and we must fight with everything we have to get it back.

Federal judge in Hawaii blocks Trump’s new travel ban hours before implementation

US News, March 15, 2017:

A federal judge in Hawaii put a temporary nationwide halt to President Donald Trump’s new travel ban Wednesday, hours before it was set to take effect at 12:01 a.m.

The judge was one of three to hear arguments in separate cases across the country Wednesday over whether to block the ban on the eve of its implementation, but the court was the first to act nationwide to put it to a stop.

The travel restrictions, laid out in an executive order signed March 6, would suspend the U.S. refugee program for 120 days and largely stop travel from six majority-Muslim countries for 90 days.

Critics have said the measures amount to religious discrimination, and in Wednesday’s arguments lawyers challenging the ban referred multiple times to Trump’s repeated calls on the campaign trail for a “shutdown of Muslims entering the United States” until “our country’s representatives can figure out what is going on.”

The president’s first travel ban, signed a week after Trump took office, was halted by a nationwide injunction issued by a federal court in Seattle on Feb. 3 and unanimously upheld by a three-judge panel of the 9th U.S. Circuit Court of Appeals in San Francisco six days later.

Issues of immigration and refugees are powers Constitutionally reserved for the President and Congress. Members of the Judiciary should not be ruling in this reserved area at all.

By the time that happens, the flood gates will have been left open too long. The Left knows exactly what they are doing delaying Gorsuch’s appointment. They’ve had this plan all along, & Trump needs to stop playing defense & go on the offense.

Why hasn’t the Congress gone “nuclear” so they can get all his appointments made?
Not only does Trump need to go on the offense but McConnell and Ryan need to do the same. Unfortunately I think Ryan and many others are really DemocRATs in disguise and are intentionally undermining Trump.
I also think criminal charges should be made against the judges – don’t think it would be hard to come up with some that will stick. Otherwise, have someone plant some drugs on the judges, have security “discover” it and put their a$$es in jail.

Initially, I must point out that the Judiciary is in place because that is where disputes can be taken whenever a legitimate dispute may arise from action or conduct of legislators or executives/administrators. I use the term “legitimate” because what I mean is that their must be parties to any dispute that can show that they have suffered or would suffer some type of injury before our free world legal system would allow the court to accept the litigation and rule on whether there was damages (injury) or that there is a reasonable likelihood of injury. Free world countries have known that for centuries, and as a result we have this third branch of government in place to provide a place where such disputes can be ruled on. Our forefathers knew it, and all reasonable and right thinking people should know that. Without that branch of government, we would have anarchy and violence, conduct unacceptable in a free society. It is true that a Judge must examine the issue involved and apply the law that is applicable before that judge can determine whether he has the power to issue a ruling that the arguments before him may result in some unjustifiable violation that he has the power to stop, in this case temporarily and ultimately permanently under the injunction procedure. Having not read the legal claims being made or any decision as of yet, I can say nothing about whether there was any legitimate legal basis that a violation might occur that would support an injunction. That issue must still be decided. Yet, I, like you, are very frustrated with this country’s failure to deal with a very dangerous reality that faces us, a reality that was avoided over the last presidency. Without overstating the problem, to me that reality is obvious from what we are seeing happening around this world as the Jihadists support their conduct by claiming the right to “cleanse” the world of all non-Muslims (infidels). Today, I heard President Trump state to Tucker of Fox News that he is trying to figure out what to do, and what needs to be done, to determine how this country can avoid the suicidal policies that have seemingly overwhelmed the Free world countries in Europe, and elsewhere. Clearly no right and reasonable person would open their door to an army that is convinced that they must take your freedom from you, convert you, or kill you. Trump is being frustrated by those who refuse to see this reality, and constantly use “racism and bigotry” as a defense to every right thinking proposal that he is trying to make to examine and determine how we can protect ourselves from those out there who will harm us. Sure I know that their are some who would be inconvenienced by the ban, but we cannot allow this potential danger to continue unabated. We have a duty to our children and future generations to find a method that will help protect us from what is happening because of a political belief system that intends to destroy our free world society. This issue is not about “religious freedom,” it is about life or death which overrules all other arguments being raised by the protestors. I hope that Trump is a man of his word and he will continue the good fight against those who refuse to face the reality that the free world faces. I hope that the appellate courts will come to recognize that the ban is both necessary and appropriate while we try to determine how best to deal with the scourge that we are facing, and come to realize that the ban is not based on any religious prejudice, but is simply based on a reality that we must now face head on, before it becomes unmanageable.

Why can’t Trump issue executive order blocking all attempts by courts to subvert executive orders that relate to safety and security of America and its citizens as its in violation of law.
If he wants he can let Americans vote on it directly by way of missed calls to given number or Poll from reliable non leftists/liberal sources to support such a move. Then use it to bring these scumbag judges in line.

Any judge who subverts such E.O should be held responsible for any deaths caused by such rulings and penalized $100,000 with Automatic impeachment.

If you allow Left/liberal judges to subvert the country and get away with it they will do it every time.

Re-settle a number of muslim immigrants in hawaii proportions to the population of the states that have had muslim colonists forced on them. There are no muslim colonists in hawaii, this prevents hawaians from reaping the benefits of islam’s contribution to multiculturalism. There must be a resettlement program of muslims in hawaii immediately.

Logic, one thing is evident today and this is Pamela Geller’s very sobering comment: “They have destroyed this country, and we must fight with everything we have to get it back.” I wonder how many Americans appreciate the sobering truth of her comment and are sufficiently dedicated to fighting back. The West and the U.S. is now truly in a mess! Here in Canada democracy is in a shambles. The Ontario government is passing a bill that will allow it to remove children from parents or guardians if at school their children don’t reflect what the government considers the ‘right’ gender ideology thinking. Why has this come about? Because Premier Kathleen Wynne is a lesbian and thinks that everyone has to regard her LGBTQ ideas the only acceptable ideas. Hers is the mentality of a totalitarian dictator, but not a journalist of note says a thing about these disgusting developments. Talk to parents and they appear totally oblivious to what is taking place – and don’t seem to even care.

Repeating what I said last time, we do need a showdown between the executive and judicial branch if they are to be co-equal branches of government. From the beginning we have had warnings that the judicial branch could overstep its bounds and become dictatorial if we concede to it all of the rights to interpret the Constitution and many legal scholars including Pres Lincoln believe that each branch was an authority regarding its limits. Trump should order that the judge’s decision be ignored and continue enforcing his lawful orders. For too long the conservatives have feared this as a constitutional crisis but the judicial branch is creating it as it consistently exceeds its authority. If the court can insist that it has the final authority over anything they claim is within its jurisdiction, we have a judicial dictatorship. The legal profession has been promulgating this faulty belief for more than a century as it was being taught when I was in law school 49 years ago without considering its implications. The court has no authority over this policy, there is no consideration for financial impact on the states and potential immigrants have no standing. Nada…Zero..this is purely a political decision and nothing more and even if the SCOTUS upheld this terrible decision, it wouldn’t make it more legitimate. The showdown would be messy but it is completely within the authority of the people and congress to remove the president if he exceeds his authority, and therein the court is powerless.

It’s possible because the legislative branch lets them do it. It is up to Congress to impeach lawless judges and they also have the power to disband all courts except the Supreme Court. But instead, they abandon their role as a check on the judicial branch and let them run amok.

Trump should ignore this illegal ruling and just order the proper agencies to enforce his order. If the agencies refuse, Trump should fire the heads of the agencies and replace them with people who will follow orders.

Never been to Hawaii but have been wanting to go for a visit, but after reading this article maybe I’ll pass. This is from the libtard Southern Poverty Law Center and some people in the article claim Hawaii is the most racist place in the USA.

I think some kind of criminal charges should be made against these judges. Why didn’t they shirt their pants when Oblabber passed the exact same 7 nation ban. Oh yes, he did – scroll over to 21:30 in this C-span video and listen for 1 minute as Jeh Johnson tells congress they passed the ban. This is from July 14, 2016:

Not a problem. Trump is the President and, as such, controls all the government mechanisms. He should simply instill the elements of the travel ban as policy for the various embassies who handle and process visa requests.

How does a foreigner who has never so much as set foot in this country have the same constitutional rights as a citizen?

How can a pro muslim federal judge ruling all over the US? I hope that this time President Trump will go on and rule out against this pro terrorist judge.
According to the Constitution President and only he, not a disgusting judge has right to put stop for immigration if the country is in danger.
In the meantime, everybody should boycott Hawaii, people should protest all over the country against this judge. Robart is silenced, but this person Watson should be kicked out as he himself is a danger to the US security

How long is it going to take Trump to learn that no matter how many executive orders he writes on muslim immigration there is always going to be a federal judge who will strike it down. Trump needs to ignore these illegal court rulings and just enforce his order. If the agencies responsible for enforcing the orders refuse to do so, Trump needs to fire the people in charge of these agencies and get people who will follow orders.

This is a war and Trump and Congress need to fight fire with fire. It’s time for the executive and legislative branches of government to tell the judiciary to go to hell. The judiciary has a specific role to play according to the Constitution. When they exceed that role it is up to the other branches to put them in their place.

Send all the immigrants to Hawaii and those other states which opposed the temporary moratorium on immigration. If I heard correctly it appears that Hawaii’s justification for opposing the ban was the damage to its economy caused by the original ban: apparently 70 tourists and 13 students were stopped from coming.

You are sadly mistaken and putting Muhammad up as a god. Here is a take with which I wholeheartedly agree; “Koran is not even third grade literature. You can see this man (Muhammad) seems to be not normal. In koran, there is nothing elevating. It is so full of rubbish. It is not a religious book at all. It has come out of a feverish mind and very mediocre. Muhammad’s life was just fighting, killing. On his sword, he has written, ‘My message is peace.”” ~ OSHO, an Indian mystic, guru, spiritual teacher and religious scholar. After intense study of Islam and after being asked for its outstanding qualities, OSHO said he searched intently for them but regrettably had only this to report.

So many countries in the West have lost their sanity in their desperation to be multicultural, politically correct, and to appear not to be discriminating against any group or religion – even when, as in this case, there is a very sound reason for doing so. It’s sad that the USA is being taken down this road by individuals like this.

As I commented to another poster recently, the only countries which will thrive and grow stronger in the future are
those who have rejected multiculturalism, where political correctness
doesn’t exist, who will not accept a mass influx of Third World
“migrants” which they know will drag them down socially and economically. Countries like Russia, Japan, China, and Eastern European
countries like Poland and Hungary. Countries who put their own people
first. The USA must stand firm and follow their example.

Let’s hope that the time arrives when Americans, so disgusted by judge’s decisions that have nothing to do with the law or the Constitution, take it upon themselves to meet the judge in a parking lot and re-arranged their outlook on life with a few good and well aimed knuckle sandwiches. CNN’s gloating this morning over this court decision was galling to behold.

Obama is like a cancer, once it was infested in this once great Republic it will take years to get rid of.
It’s a shame that Trump can’t get rid of these Democommie judges once and for all.
Just my 2 cents worth.

Unfortunately it is probably going to take another Muslim attack with many lives lost before the U.S. Liberal/left has a change of heart, but having noted their gross stupidity – this reflected in Glenn Beck’s scornful comments about Pamela and Robert Spencer prior to interviewing Zuhdi Jasser (the Islam “reformer”!!) this week – it’s almost certain that even this will not shake their mentally deranged thinking. It’s now abundantly evident that Glenn Beck, apart from not being particularly well read, is in fact quite a stupid and gullible fence-sitting individual. Regarding Jasser, the Islam “reformer’ – according to the ‘brilliant’ Glenn Beck – did anyone notice that Egyptian President al-Sisi’s 2015 appeal to large gathering of imams to reform Islam brought no results? Beck said he’d known Jasser about 15 years. Has anyone recorded any Islamic reforms since Jasser began his supposed reform efforts?

Should anyone die as a result of this liberal, activist judge’s ruling their blood will be on his hands. We are at war against Islamic supremacists. The president’s responsibility is to protect us. Therefore, anyone who prevents him from doing so should be, summarily, arrested and prosecuted for sedition (if not other charges as well).

It’s a policy oriented decision. Trump’s executive order is not demonstrably different from Jimmy Carter’s 1979 executive order banning Iranian students and nobody seemed to care then. Congress and Presidents have a long history of banning various groups of people and nobody seemed to think it was unconstitutional then. See the Wikipedia article “List of United States immigration Laws” including the 1953 decision “Kwong Hai Chew v. Colding Template” where the court found “The Bill of Rights is a futile authority for the alien seeking admission for the first time to these shores.” As for the 1965 Immigration Act banning discrimination on the basis of nationality if that had been followed closely the most number of immigrants would have come from China, followed by India and so on. Instead the law has been interpreted as being a guideline not something hard edged. The same deference should be given to President Trump. If the law is unclear the benefit of the doubt is supposed to be given to Congress and the President. It is time for the Senate to step up and begin throwing judges off the bench.

The six countries affected by the ban are unstable, undemocratic and known to sponsor and export terrorism: why would any country not be wary and suspicious of having its citizens on their soil?

There is a liberal view that somehow Syrians are a special case, peaceful and law-abiding. Yet just 11 years ago, newspapers were reporting this: “Thousands of Syrian demonstrators stormed the Danish and Norwegian
embassies in Damascus today, setting fire to both buildings in protest
against caricatures of Islam’s prophet.
Police fired tear gas and water cannons to disperse demonstrators
who had move on to the Norwegian embassy after setting fire to the
Danish embassy, about six kilometres (four miles) away. But the
protesters broke through police barriers and set fire to the building,
shouting “Allahu Akbar” (God is Great).

Easy solution for Trump: Have Secretary of State Rex Tillerson order all consulates in those six countries (or any other country he chooses!) to stop issuing travel visas. No visas, no entry into the U.S. No leftist judge in the U.S. can do a darn thing about it.

OBT, open borders for terrorists is a Soros group with the simple plan to equalize the horror of war from being confined to radical Islamic states. Why is if fair for ISIS to murder everyone in Syria, this needs to be exported worldwide as it is grossly unfair that we live in peace while some other country is at war..
The plan is simple even without the addition of Islam into the equation

Drive by shootings should happen all over the USA not just the south side of Chicago, to be fair, housing choices must be based on a persons skin color and violent criminal background..
offer free mortgages for the gang members to live in huge mansions in exclusive neighborhoods and the drive by shootings in the USA can finally be equally distributed..

The inherent virtue of social engineering is the equal sharing of misery..
