Democrat Unveils CRUSHING Bill To Suppress Non-Government-Approved Free Speech

The liberals are on a death march. The death of freedom. The death of individual rights. The death of America.

First off, let me say that such a bill would personally benefit me enormously. There is so much hate, lies, defamation directed at me online, it is staggering. But I endure the smears and lies because that is what is required under the First Amendment. That said, I vehemently oppose this bill. We will wage war against this bill. This bill would be the club to silence those who oppose the left. This bill would scrub the information superhighway of their crimes.

Freedom of speech is the foundation of a free society. Without it, a tyrant can wreak havoc unopposed, while his opponents are silenced. Putting up with being offended is essential in a pluralistic society in which people differ on basic truths. If a group will not bear being offended without resorting to violence, that group will rule unopposed while everyone else lives in fear, while other groups curtail their activities to appease the violent group. This results in the violent group being able to tyrannize the others.

The Washington Post’s Eugene Volokh: “…under this bill, newspapers, scholarly works, copies of books on Google Books and Amazon, online encyclopedias (Wikipedia and others) — all would have to be censored whenever a judge and jury found (or the author expected them to find) that the speech was “no longer material to current public debate or discourse” (except when it was “related to convicted felonies” or “legal matters relating to violence” in which the subject played a “central and substantial” role).

In a bill aimed at securing a “right to be forgotten,” introduced by Assemblyman David I. Weprin and (as Senate Bill 4561 by state Sen. Tony Avella), liberal New York politicians would require people to remove ‘inaccurate,’ ‘irrelevant,’ ‘inadequate’ or ‘excessive’ statements about others

  • Within 30 days of a ”request from an individual,”
  • “all search engines and online speakers] shall remove … content about such individual, and links or indexes to any of the same, that is ‘inaccurate’, ‘irrelevant’, ‘inadequate’ or ‘excessive,’ ”
  • “and without replacing such removed … content with any disclaimer [or] takedown notice.”
  • “ ‘[I]naccurate’, ‘irrelevant’, ‘inadequate’, or ‘excessive’ shall mean content,”
  • “which after a significant lapse in time from its first publication,”
  • “is no longer material to current public debate or discourse,”
  • “especially when considered in light of the financial, reputational and/or demonstrable other harm that the information … is causing to the requester’s professional, financial, reputational or other interest,”
  • “with the exception of content related to convicted felonies, legal matters relating to violence, or a matter that is of significant current public interest, and as to which the requester’s role with regard to the matter is central and substantial.”

Failure to comply would make the search engines or speakers liable for, at least, statutory damages of $250/day plus attorney fees.

As The Washington Post’s Eugene Volokh rages, under this bill, newspapers, scholarly works, copies of books on Google Books and Amazon, online encyclopedias (Wikipedia and others) — all would have to be censored whenever a judge and jury found (or the author expected them to find) that the speech was “no longer material to current public debate or discourse” (except when it was “related to convicted felonies” or “legal matters relating to violence” in which the subject played a “central and substantial” role).And of course the bill contains no exception even for material of genuine historical interest; after all, such speech would have to be removed if it was “no longer material to current public debate.” Nor is there an exception for autobiographic material, whether in a book, on a blog or anywhere else. Nor is there an exception for political figures, prominent businesspeople and others.

But the deeper problem with the bill is simply that it aims to censor what people say, under a broad, vague test based on what the government thinks the public should or shouldn’t be discussing. It is clearly unconstitutional under current First Amendment law, and I hope First Amendment law will stay that way (no matter what rules other countries might have adopted).

Remember: There is no “right to be forgotten” in the abstract; no law can ensure that, and no law can be limited to that. Instead, the “right” this aims to protect is the power to suppress speech — the power to force people (on pain of financial ruin) to stop talking about other people, when some government body decides that they should stop.

So Democrats use the Constitution on the one hand to apply it to non-citizens to obstruct the entry ban from dirtbag countries and then turn around and totally disregard it when it comes to their actual constituency. Every day is a new exercise in hypocrisy from these wanna be totalitarians.

these people are pure evil . they want to censor speech so they can engage in their wanton sinfulness and have no one speak of it .this non bill would essentially and radically change world history in america . how can we then discuss hitler,the holocaust , genocides ,slavery , the civil war ,etc . can we discuss the bible ,quran or any other religious historic books ,what about sex offenders murderers and rapists ? do these brainless wimps even think b4 they speak. this speaks to the corruption and rot in the system ,the fact that lots of our elected reps are retards with no clue about governance.
there is no such thing as a ”a right to be forgotten”rather everyone reserves the right to choose what to remember or forget. a law needs to be passed regarding a stringent test of knowledge and understanding of the american constitution before even running for elected office.we need to call and bombard their offices with written and verbal opposition to this repressive bill and make sure people who even promote such calumny do not come an inch near a ballot box or ever run for office .

The assembly is the lower house of the state legislature, where crackpot bills – like the ones you people tend to love on the federal level – are often born and usually die. Bills proposed in the lower houses are a dime a dozen and often exist just so the legislator can grandstand or pretend to keep a campaign promise.

There is an argument to be made for the right to be forgotten in countries that have very strong privacy laws, like Germany, but we don’t have a legislative basis for it here. You can scream about it if you like, but it’s little more than a gesture.

Are assemblymen elected, or chosen in another manner? Since we just have counsel members, I’m not sure how that works. If he was elected, those that elected that person should have vetted him better. If appointed, then the person/persons that
placed him there better throw him out.

Those in the media and politics who see fit to criticize Pamela for exercising her constitutional liberties to express her opinions need to be reminded that those are the very same liberties that allow the media and political discourse to even exist in the first place. Ask this question; who would promote legislation to shut down debate?

The first amendment is crystal clear:
1) Congress shall make no law respecting an establishment of religion,
2) or prohibiting the free exercise thereof;
3) or abridging the freedom of speech, or of the press;
4) or the right of the people peaceably to
assemble,
5) and to petition the Government for a redress of grievances.

And now this by New York Legislators.

George Orwell was an insider. He socialized with the elite crowd, until he began hearing about their plans for a NWO. Disgusted, he rejected them. He wrote a book. We were warned. This is not really about parties but about those who control them and have for a very long time. Until we acknowledge and address this as the real issue, then, we will not be able to do anything about it. We are very fortunate to have Trump and others like him, who are not owned by the elite cabal and to have had the first real elections in generations in which cabal candidates did not win. We should make good use of them before it is too late. It is way past time to wake up.
