Anti-Sharia Law Bill Passes In Montana House Judiciary

It is time to stand up for American rule of law and individual rights for all. And Montana is doing just that. This is Montana’s version of an anti-Sharia law bill, modeled off similar legislation that has passed in Louisiana, Kansas and Tennessee.

This should be the proverbial no-brainer. And yet the fact that such laws are met with so much resistance, both overt and covert, indicates how very needed they are.

How can anyone oppose a law that seeks to prevent foreign laws from undermining fundamental constitutional liberties? We now have groups that has ever come to this country with a ready-made model of society and government they believe to be superior to what we have here and are working to institute it.

For example, Islamic law contravenes American freedoms in numerous particulars.

We have seen sharia law in New Jersey. Back in July 2010, a Muslim husband raped his wife, and the judge determined that no sexual assault occurred because Islam forbids wives to refuse sex on demand from their husbands. Luckily, the appellate court overturned this decision, and a Sharia ruling by an American court was not allowed to stand—this time. But there have been over a hundred cases of Sharia jurisprudence in the US, and Jeffery Mittman of the ACLU has testified that “all have been overturned by a higher courts, therefore there is no problem since the American constitutional system worked.” Of course, this begs the question of why should this have happened in the first place. Secondly, it is simply not true that all cases have been overturned. In fact, there are cases in California and Maryland in which trial courts were overturned by appellate courts, the latter of which turned the blind eye to the threat from sharia.

The irony is that the ACLU would oppose a law that seeks to prevent foreign laws from undermining fundamental constitutional liberties.

Legal expert David Yerushalmi, a pioneering legal authority in the drafting of such state laws, points out that “the global jihad leadership against which we have aligned most of our military and intelligence resources since 9/11 informs us in Arabic, Pashtu, Urdu, Persian, and even in English that the global jihad against the West is fundamentally directed and determined by Islamic law, or sharia. The jihad leaders further tell us that their ultimate goal, in addition to that of the ‘defensive jihad’ incumbent on every Muslim to rid the Islamic world of an occupying infidel presence is the implementation of sharia law as the law of the land in any place Muslims step foot.”

“Surveys in the Muslim world consistently evidence that somewhere between 50% to 70% of the global Muslim community desires to create a unified Caliphate for all Muslims and to order that political hegemony according to a strict al Qaeda-like sharia.”

The separation of mosque and state is essential to preserving American freedom and our way of life. Yet the Islamic supremacists have made real inroads. We have seen over the last few years the encroachment of Islam on the secular marketplace. Muslims have demanded, and received, special accommodation in public schools, in the workplace, in our government, and in privately owned businesses.

One only needs to look at the disintegration of Europe and the establishment all over that continent of enclaves in which Sharia is enforced and the law of the land disregarded, to glimpse a bleak future made possible by “good intentions” and the failure of multiculturalism. In those areas of Europe, women and non-Muslims suffer institutionalized discrimination, and there is no freedom of speech or freedom of conscience.

A bill to ban foreign laws in Montana courts that many have described as an anti-Sharia law bill, passed the Republican-controlled House Judiciary Monday. Senate Bill 97, which passed along party lines by an 11-8 vote, will now move to the House floor for debate.

Although the bill does not specifically mention Sharia law, the term was used by both those supporting and opposing it during hearings, Montana Public Radio reported. Opponents claimed that the law would further anti-Muslim sentiment, while proponents argued that Sharia law could be used as a defense to abuse women or marry minors.

Republican Representative Seth Berglee conceded that he was not aware of any such instances in Montana but said that he had been informed of examples in other states where people attempted to get the court to enforce foreign laws.

“It might not be a problem in Montana but we make prospective laws all the time,” Burgle said. “So I think this is a good bill.”

Supporters of such bills often point to a New Jersey case from 2009 when a family court judge ruled that a woman could not be granted a restraining order against her husband who had sexually assaulted her, based on Sharia law. However, the verdict was later overturned.

The American Civil Liberties Union has argued that such laws are unconstitutional….

“This effort is not solving a problem, but it is simply based on an out-of-state model in policy that is a direct reaction to Islamophobia and it is an underhanded effort to spread an alarmist message about Islam in order to keep Muslims in the United States on the margins,” Rachel Carroll Rivas, co-director of the Montana Human Rights Network, said. “This is simply a policy rooted in xenophobia that is unfounded and unfair.”

It is truly hard to comprehend why any LEGAL American would OPPOSE U.S. law over FOREIGN law. U.S. law should be a given but as you can see there IS opposition to U.S. law being the LAW OF THE LAND.

If there are pedophiles and communists in our government they need to be gone. Anyone who votes against these bills should be ousted immediately. There is really no room for debate on this topic. Sharia Law should not be allowed in the United States by ANYONE including muslims. This is not an accepted practice in America.

So, the ACLU doesn’t think there’s a problem, since cases can later be overturned?
—Obviously, these leftist attorneys are enjoying their massive taxpayer supported fees, as this type of case is their ticket to wealth, and short-lived fame.
—-This type of law illustrates good stewardship of taxpayer money, as it prevents nuisance charges and lawsuits. Of course, that’s exactly why the ACLU opposes it, since nuisance lawsuits are their pot of gold.
—-Opponents of this bill “claimed that the law would further anti-Muslim sentiment.” Really? That actually sounds like a consequence of NOT passing such a law.
—-the ACLU position begs the question: Who are their donors? My best guess is overt or covert MB and CAIR groups.

Why would any sane American agree to be bound by foreign laws in America? The American constitution guarantees freedoms and rights that many other legal system deny. Why would America submit to tyranny, enforcing it through allowing foreign courts and law to dictate American internal policy?

We are already technically bound by some UN treaties made by every Democrat since John F. Kennedy, and none of them are beneficial to the American people. That’s why we need to throw the UN out…. they are a foreign government alien to US sovereignty and the Constitution. We are the only nation that can just say “no” and break these stupid treaties. The rest of the world needs US money to fund their wars, so I do not worry about worldwide retaliation. The problem as I see it is our rule of law and justice system has allowed groups like this to flourish because of political correctness and the incessant law suits and complaining by all the liberal groups in this country. These same people would be the first ones to cry foul when radical Islamic terrorists attack their homes and neighborhoods and complain we didn’t do enough to protect them.

Most are qualified when first hired, then they get tenure in about 5 years. Almost impossible to get rid of them. However, some administrators of some universities hire people like Angelia Davis and Bill Ayers on purpose.

We should not even have to vote on such a measure. Not even consider it. America is not Sharia. Is this an invasion? A not so subtle takeover? This is not who we are. Do Americans go to the Middle East, or thereabouts to push their views? Why is it that America must be pushed over all the time, while no one questions their countries. You must know they laugh at America. The left has done this to you, to the world, with their nonsensical pc views.

The first order of things is to demand that any Muslim entering this country swear to take an oath upholding the freedom and constitutional laws already rooted in this country. Anyone trying to challenge our freedom with Sharia shall be subject to deportation and classified an enemy of the state and be deported. Also all of those that wish to promote the destruction of Israel and create a viable Palestinian state should also be under the subjection of American law.

I do understand Islam. I was aware of that. But what else are you going to do? Some Muslims may obey it because they are not that devoted. They should not allow any of them in but you have these idiots in higher places that do not have a clue about what true Islam represents and so we are all screwed…

It would be great to think that but truth be told don’t expect it quite this soon…Hell the antichrist hasn’t even appeared on the world stage yet so that needs to happen first. I know I will recognize him when he comes to power. I know what to look for and where. Look for Christ’s return anywhere from 730,000 to 735,000 days after he died on the cross either in 33 or 34 C.E. I have done my research and am probably more knowledgeable about prophecy than anyone else out there.

There is an organization called “Act for America” that has had great success in getting “American Laws for America” instituted in many states. I have the utmost respect for their founder Brigitte Gabriel. She loves America as much as Trump.

We need to de-recognize anything Islamic as a religion. First, it is primarily a political system, hell-bent on subduing and conquering the world, with no consideration for the preferences of the present inhabitants. Second, since they want to overthrow our constitution, this is equivalent to treason and no Muslim should ever be admitted to the USA!

Simply declare the entire group as treasonous since they want to overthrow our constitution and government. Forbid them on that basis. Leave religion out of the picture. View them as primarily a political group, and NOT as a religious group.

Correct. It is a “made up” word. A phobia is an unreasonable or unjustified fear toward something…anything. Read the qur’an and other sources about islam and “Big Mo” and what he said and did. At that point any fear, you feel, toward islam cannot be called a “phobia” as that fear will be real and justified. Islamophobia is just another word used as a tool…just like the word “racist” is used as a tool to try and humiliate and shut people up.

Montana and the other states with similar measures are on solid ground. According to the Supremacy clause of the US Constitution, federal law is above all others, including sharia. The public has the same attitude toward it as it had against communism after WWII. It has been seen in action and we decided against it. How can you argue against freedom of choice?

Anyone supporting Sharia Law is anti-American and has no intention of assimilating. How is it possible for anyone to become a US citizen when they support Sharia? That should be a major part of our vetting system and should automatically disqualify entry into the US or instant removal from our country.

Why does this need to be done state by state when there is already a federal law against other laws beside those that are instated by the United States Government. This should not be a state choice but a country-wide mandate. Anyone who would vote against this should not be in the government our country AT ALL.
