Antonin Scalia, Supreme Court justice, dies at 79

(CNN)U.S. Supreme Court Justice Antonin Scalia, a leading conservative voice on the high court, has died at the age of 79, a government source and a family friend told CNN on Saturday.

Scalia died in his sleep during a visit to Texas.

President Ronald Reagan appointed Scalia to the U.S. Court of Appeals in 1982. In 1986, he nominated Scalia to the Supreme Court.

A government official said Scalia went to bed Friday night and told friends he wasn’t feeling well. Saturday morning, he didn’t get up for breakfast. And the group he was with for a hunting trip left without him.

Someone at the ranch went in to check on him and found him unresponsive.

The U.S. Marshals Service is not investigating Scalia’s death, an official told CNN. They are helping to arrange for his body to be returned.

They were present because marshals sometimes help supplement security for traveling justices.

In a statement, Chief Justice John Roberts said he and other justices were “saddened” to hear of Scalia’s passing.

“He was an extraordinary individual and jurist, admired and treasured by his colleagues,” Roberts said. “His passing is a great loss to the court and the country he so loyally served. We extend our deepest condolences to his wife Maureen and his family.”

Deputy White House Press Secretary Eric Schultz said President Barack Obama was informed of Scalia’s passing on Saturday afternoon.

“The President and First Lady extend their deepest condolences to Justice Scalia’s family. We’ll have additional reaction from the President later today,” Schultz said.

Major political fight looming

Scalia’s death in an election year sets up a titanic confirmation tussle over his successor on the bench. The already challenging task of getting a Democratic president’s nominee through a Republican-controlled Senate will made even more difficult as the fight over Scalia’s replacement will emerge as a dominant theme of an already wild presidential election.

Soon after news of Scalia’s death surfaced, Senate Majority Leader Mitch McConnell called for the vacancy to be filled after Obama’s presidency ends.

“The American people‎ should have a voice in the selection of their next Supreme Court Justice. Therefore, this vacancy should not be filled until we have a new president,” McConnell said in a statement.

But McConnell’s Democratic counterpart, Harry Reid, called for the seat to be filled “right away.”

“With so many important issues pending before the Supreme Court, the Senate has a responsibility to fill vacancies as soon as possible,” Reid said in a statement. “It would be unprecedented in recent history for the Supreme Court to go a year with a vacant seat. Failing to fill this vacancy would be a shameful abdication of one of the Senate’s most essential Constitutional responsibilities.”

Major presence on high court

Appointed to the court in 1986 by President Ronald Reagan, Scalia was a conservative icon who transformed the court by instilling in it his belief that judges should follow the precise words of the Constitution and not apply a modern interpretation.

He was the first justice of Italian-American heritage and passed through confirmation with a unanimous vote.

Scalia changed oral arguments as he became an active participant with tough questions for advocates.

He will be best known, perhaps, for his landmark decision District of Columbia v. Heller, holding that the Second Amendment protects the right to posses a firearm at home. He was a critic of Roe v. Wade and dissented in last term’s same-sex marriage cases.

He wrote a stinging dissent in the same-sex marriage case Obergefell v. Hodges, calling the decision a “threat to American democracy.”

He believed that marriage should be decided by the people not the courts, and he was concerned that some members of the bench might determine that the death penalty is unconstitutional.

Scalia caused a stir as recently as December when he made controversial comments during a hearing about the future of a program at the University of Texas that takes race into consideration as one factor of admissions.

Scalia pushed a point that had been made in some friend of the court briefs filed in the case. It concerns a theory called “Mismatch” popularized by authors Stuart Taylor Jr. and Richard Sander that suggests affirmative action programs don’t always benefit minorities.

Although Roberts had mentioned the theory in a different case in 2013, Scalia’s language was blunt.

“There are those who contend that it does not benefit African-Americans to get them into the University of Texas, where they do not do well, as opposed to having them go to a less-advanced school, a slower-track school where they do well,” he said.

“One of the briefs pointed out that most of the black scientists in this country don’t come from schools like the University of Texas,” he said.

Conservative in thought, not in personality

The jaunty jurist was able to light up, or ignite, a room with his often brash demeanor and wicked sense of humor, grounded always in a profound respect for American law and its constitutional traditions.

“What can I say,” was a favorite phrase of the man colleagues knew as “Nino.” As it turned out, quite a lot.

“Justice Scalia had an irrepressibly pugnacious personality,” said Edward Lazarus, a former Supreme Clerk law clerk who wrote about the experience in “Closed Chambers.”

“And even in his early years of the Court, that came out at oral argument when he was the most aggressive questioner. And behind the scenes, where the memos he would write — what were called ‘Ninograms’ — inside the court had a real galvanizing effect on the debate among the justices.”

A sharp mind combined with a sharp pen allowed Scalia to make his point, both to the pleasure and disappointment of his colleagues and the public.

“He could be belligerent, he was obviously very candid about he felt about things,” said Joan Biskupic, a USA Today reporter who wrote a biography of Scalia. “He loved to call it as he saw it, completely not politically correct. In fact, he prided himself on not being PC on the bench in court.”

His New York and Mediterranean roots — “I’m an Italian from Queens” he was fond of saying — helped fashion a love of words and debate, combining street smarts with a well-calculated conservative view of the law and its limits on society.

“He was very good with audiences that weren’t predisposed to like him,” said Paul Clement, a former Scalia law clerk. “He was incredibly disarming and charming in his own way.”

Scalia, a Catholic, regularly attended Red Mass before each term. He and his wife had nine children and 28 grandchildren.

His best friend on the bench was Justice Ruth Bader Ginsburg, who he called his “best buddy” on the court. Last winter, they appeared together in a wide-ranging discussion on Constitutional issues.

“Why don’t you call us the odd couple?” Scalia said.

Political world reacts

Reaction and condolences quickly poured in from politicians and presidential hopefuls. President George H.W. Bush, who was vice president when Scalia was appointed to the court, called him one of Reagan’s “many enduring legacies to the United States.”

“Both his admirers and his detractors agreed that Justice Scalia was one of the sharpest constitutional intellects to ever serve on the bench,” Bush said in a statement. “I considered him a personal hero, and Barbara and I were honored to call him a friend. Our heart breaks today for our country, but especially for his wife Maureen and his nine children and extended family. His death is a great loss for us all.”

GOP 2016 front-runner Donald Trump issued his condolences to Scalia’s family in a statement, but tweeted that his death is a “massive setback” for conservatives.

“The totally unexpected loss of Supreme Court Justice Antonin Scalia is a massive setback for the Conservative movement and our COUNTRY!” Trump tweeted.

Republican presidential candidate Ted Cruz , a former clerk on the Supreme Court, responded to the news of the death of the conservative Supreme Court Justice Antonin Scalia by calling him “one of the greatest justices in history.

Scalia was found dead Saturday in Texas.

Today our Nation mourns the loss of one of the greatest Justices in history – Justice Antonin Scalia. A champion of our liberties and a stalwart defender of the Constitution, he will go down as one of the few Justices who single-handedly changed the course of legal history.

As liberals and conservatives alike would agree, through his powerful and persuasive opinions, Justice Scalia fundamentally changed how courts interpret the Constitution and statutes, returning the focus to the original meaning of the text after decades of judicial activism. And he authored some of the most important decisions ever, including District of Columbia v. Heller, which recognized our fundamental right under the Second Amendment to keep and bear arms. He was an unrelenting defender of religious liberty, free speech, federalism, the constitutional separation of powers, and private property rights. All liberty-loving Americans should be in mourning.

Justice Scalia’s three decades on the Court was one of President Reagan’s most consequential legacies. Our prayers are with his beloved wife Maureen, their nine children, and their precious grandchildren.

      Step 1 in this case is to find out what was the cause of death. Then, let’s hear who those “friends” were that he supposedly told he wasn’t feeling well. Let’s hear it from their own lips. Let’s see some REALLY sophisticated tests for toxicology, etc, and let’s make sure no DemonRATS touch the body – it should be guarded 24/7 until the autopsy.
      Next, Paul Ryan, shall make it clear that Obola need not waste his time picking a replacement because they will not even look at them. Also, Ryan shall make it clear that no appointment shall slip thru during some kind of recess, or using any other trick. Congress shall make it clear that in no circumstance shall a Supreme Court justice be nominated by Obola and if necessary they will shut down the government until the inauguration of a Republican president, even if that doesn’t occur for 5 years or longer.

There would be no trouble dissolving this in a glass of red wine. It is not stable in vivo and would be gone by the time the autopsy was performed. There are many other possible poisons which could also have been used, but this one in particular is very accessible.

      It’s the propellant in your car’s airbag. Automotive airbags contain tens of grams of sodium azide. How can less than a gram kill you? The lethal biochemistry is: “Azide inhibits cytochrome oxidase by binding irreversibly to the heme cofactor in a process similar to the action of carbon monoxide. Sodium azide particularly affects organs that undergo high rates of respiration, such as the heart and the brain.”

      In the Symptoms of Sodium Azide Chemical Poisoning, note two: skin redness and reduced blood pressure. The latter could account for the “white band” above his bright red face.

      Sodium azide is especially toxic to the heart and hence causes a rapid extreme drop in blood pressure. Breitbart may not have had enough blood pressure to pump blood up to the top of his head, so that blood would drain down, and he would faint. If the heart stopped at that time, the poisoned blood would never be pumped to the top part of his head, hence the white band on top.

      Note that symptoms such as blisters are caused by exposure to dust and would not occur if it were drunk – say, in a glass of wine.

      So, what was Andrew Breitbart doing just before he died? Having a glass of wine with a stranger, a man whom he had never met before, at the bar of The Brentwood.

      The stranger was Arthur Sando.”

      It seems to me that such an investigation would not be called for unless an autopsy indicated foul play. That said, such an autopsy should be performed promptly.

    In the State of Ohio, supreme court justices are elected by the will of the people, and have certain term limits. Sadly, the people have no say who gets appointed to the U.S. Supreme Court as career judges. In any case, Antonin Scalia persevered 30 years in the midst of opposition from at least five other judges. I tremble at who may replace him!

    Very sad. However, I think he should have walked out of the Supreme Court in protest over the Same Sex marriage law-fare vote. It was a religious rights issue and in effect burned the bible just as surely as if the gestapo secular progressive baby killer’s went door to door got your bible’s, put them on a pile and burned them. Writing a strong dissent was not enough. Being the friendliest conservative judge is not enough. The nice guys in leadership have lost our right to even be a nation any longer. We now qualify for the dustbin of history. We have allowed the barbarians among us to throw out the standard for defining normal, moral and sane. We are bankrupt in every conceivable way. We are a nation of idolators. All that is left is to do is repent or await the judgment of God.

    This is incredibly bad news. Yet the enormity of the situation will be lost on many individuals who consider themselves to be well informed conservatives. I have a buddy who calls me occasionally to breathlessly tell me about something he’s heard on Savage. I read so I’m usually way ahead of him. This is a guy who can’t name a single supreme court justice, much less if any individual justice leans left or right.
    I had thought Ginsberg would be the next one to go and Obama really couldn’t do much to tilt the court replacing such a far left judge. But with Kagan and Sotomayor as his past appointments, I cringe at what the lame duck jihadi may do to the court.

    They’e going with “natural causes,” heart attack and now — just move on.
    To me, the failure to do an autopsy with thorough toxicology is a virtual admission that they murdered the Supreme Court Justice. I’m disappointed in the family for not conceding the absolute necessity of conclusive answers for the country.
    And now we’re left to count on McConnell to stand fast against the African thug — something that he has never done! They probably won’t even have to murder him.
