NYPD Agrees to Settle Sharia-Inspired Muslim Surveillance Lawsuits, No Payment, No Damages

We are allowing groups like the Hamas-tied Council on American-Islamic Relations, which has opposed all counter-terror measures and advises Muslims not to cooperate with the FBI, to formulate our response to the jihad terror threat. Jihad is the problem. We cannot profile jihad. This is madness.

Previously, a New Jersey judge, had ruled the program was an anti-terrorism campaign and not a civil rights violation, dismissed a similar lawsuit brought against the NYPD on the other side of the Hudson. But that didn’t stop the enemy within. They keep on fighting. This is a lesson our side must learn and adopt. Never ever give up.

Mayor Bill dhimmi Blasio made this an issue in his campaign for Mayor of New York in 2013. Soon after taking office, his administration began meeting with Muslim leaders. They have been doing their bidding ever since.

Under today’s  agreement, the agency must strengthen oversight of its surveillance practices, including adding a civilian attorney as a monitor. The good news is that the NYPD refused to pay the jizya. “The NYPD admitted no liability or violation of law in the settlement. There was also no payment of any monetary damages to anyone under the agreement.”

The mayor, under the deal, will name a civilian attorney from outside the NYPD to ensure the department’s work follows the established guidelines. The appointee will serve a five-year term.

The attorney would also have access to the mayor and a federal judge if any concerns arise.

A landmark settlement over the NYPD’s controversial Muslim surveillance program will leave the cops under the scrutiny of an independent observer appointed by City Hall.

The deal, announced Thursday by police and the New York Civil Liberties Union, resolves the twin lawsuits brought in New York against the NYPD for its post-9/11 program focused on the city’s Muslim community.

“This settlement is a win for all New Yorkers,” said NYCLU Legal Director Arthur Eisenberg. “It will curtail practices that wrongly stigmatize individuals simply on the basis of their religion, race or ethnicity.”

The mayor, under the deal, will name a civilian attorney from outside the NYPD to ensure the department’s work follows the established guidelines. The appointee will serve a five-year term.

“If that person has any concerns … they can and must go to the police commissioner and bring (their) concerns to his attention,” said NYPD Deputy Commissioner of the Legal Bureau Larry Byrne.

The attorney would also have access to the mayor and a federal judge if any concerns arise.

The observer will attend NYPD internal meetings to insure the department is “complying with the current guidelines,” said Byrne.

The settlement followed months of talks that began in the summer of 2014, shortly after Mayor de Blasio took over at City Hall. It still needs court approval from judges overseeing the two lawsuits resolved by the deal.

The New York Civil Liberties Union filed a Brooklyn Federal Court suit in June 2013 charging the Muslim surveillance program targeted people based solely on their religious beliefs.

The lawsuit named former Mayor Bloomberg and ex-NYPD Commissioner Raymond Kelly as defendants.

Imam Hamid Hassan Raza, the lead plaintiff in the suit, said the Muslim community was simply insuring its constitutional protections.

Wouldn’t true “moderate” Muslims assist not attack counter terror programs to purge their communities of jihadists?  Instead they sued on their behalf.

“In America, we have the right to stand up and speak out in response to unfairness and injustice, just as throughout this country’s history, other minorities have done the same thing,” said Raza.

A second suit argued the NYPD’s surveillance of Muslims violated the long-standing consent decree in the case of Handschu vs. Special Services Division.

The Handschu guidelines date to 1985 following a class action suit to protect New Yorkers from wrongful police attention based on their lawful political and religious activities.

The settlement “codifies changes that the NYPD had already made in its practices,” said Byrne.

The NYPD admitted no liability or violation of law in the settlement. There was also no payment of any monetary damages to anyone under the agreement.

NYPD counterterrorism czar John Miller said the settlement would not change any current departmental policy.

“New York will be as safe on Friday as it was on Thursday because we haven’t lost any of our powers to launch, renew or maintain investigations,” said Miller.

City and police officials adamantly maintained the intelligence-gathering efforts, launched after the 9/11 takedown of the World Trade Center, were a legitimate tactic to prevent a terrorist attack.

A New Jersey judge, ruling the program was an anti-terrorism campaign and not a civil rights violation, dismissed a similar lawsuit brought against the NYPD on the other side of the Hudson.

That lawsuit was filed in federal court in June 2012.

    Why is not possible to include a clause that nypd will record all teachings in temples , jew temples and churches , as reuired, and if something is against law , only based on recording will nypd take action.

        What is urgently need are voters who think about what they are voting for and the possible existence of unforeseen consequences to their actions. As a very significant percentage of muslims are in complete favour of shari’a law, a politician who is beholden to the muslim vote to get elected, will have to cut the throats of their fellow americans in political payment to foreign interests. Think before you vote. Ask yourself why the present democrats in the white mosque say and do what they are.

    These are my thoughts on the affect Islam is having on our
    world today. Though my next comment may generate a certain degree of animosity,
    I think it needs to referred to at this point in these comments. History has
    established that the some of the followers of most religions tend to accept their belief system with so much fervor, that it leads to conflict between its believers and
    those who are believers of another religious system, as well as those who do
    not believe. While I totally respect any person’s willingness to believe in
    their chosen belief system, no matter how fervent that may be, as long as their
    belief does not result in any conflict with others not of their same belief
    system; the facts are that religion is the trigger for many of the evils that
    exist today, especially from those within the Islamic belief system. To deny
    that reality is to deny what to me is obvious. Though we have a Constitution
    that protects anyone’s right to practice a religion of their choosing, that
    same Constitution does not permit anyone from using, promoting, teaching and
    preaching that their religion is not only superior to all others and that
    non-believers are to be held in disdain, resulting in some of its believers reacting violently to non-believers. That is where religion losses all of its substance and is no longer protectable under our Constitution.

    Religion is to me a belief in a God resulting in a sense of righteousness,
    even-handedness, piety and good neighborliness. Religion does not allow for the development of beliefs that would or should ever result in hate that prompts one to
    act with violence to another not of your belief system. For centuries we have
    seen how religions have been used to justify anti-Semitism. Jews have for eons been the subject of hate that emanates from the other religions of this world, as have many other groups, depending where you are examining your history. To me it makes no sense, and such conduct is entirely inconsistent with what religion was intended to be and should be.

    Islam today has fostered such hate and violence that to me
    it has lost all the protection granted to it by our Constitution. That is not
    to say that anyone should be denied his chosen right to practice his religion;
    yet, it does not allow one to use his belief system to teach or promote hurtful
    acts against any other people. Since we should all recognize that Islam is the
    underlying source of that heinous type of conduct, I believe this world has the
    right, especially here in America, to continuously be able to investigate and
    prosecute any people who promote such heinous conduct.

    I do not believe that non-Islamic leaders would object to the kind of surveillance that would be used to determine if the promotion of foul conduct is being preached, with prosecution of those who would push their believers to such conduct. Why should we not do the same within the Islamic community, especially since that seems to be where all the violence is being triggered?
