MTA votes to trash the First Amendment

A century of free speech in New York’s most public square — the streets, the buses, the subways — came to a screeching halt today when the MTA voted to ban all issue and political advertising. The other topic of discussion, by the way, was the billions in debt the MTA was. The five public speakers, including me (I’ll have video shortly), all spoke in defense of free speech, opposing the ban. Every board member who spoke in the executive session, with the exception of Charles Moerdler, spoke in defense of free speech. But the vote for the ban passed —  a craven sore loser move in light of our AFDI victory in court last week. Enemies of freedom are rejoicing across the world.

The meeting kicked off with discussion about the MTA’s billion-dollar debt. Still, this irresponsible and totalitarian vote against political ad revenue was voted in. What’s interesting, but not surprising, is Moerdler, who led the jihad against free speech. Here’s what’s not surprising: what’s not surprising is that the discussion was not about the jihad ads. Moerdler, in a vicious and disgusting tirade, attacked our BDS ads that expose wealthy Jewish donors who support Boycott, Divestment and Sanctions initiatives against Israel. I strongly urge you to watch his villainous remarks when we have the video up sometime today. Moerdler railed against our ads exposing wealthy donors’ support of the New Israel Fund, which supports BDS organizations, shrieking about lashon hara. Actually, truth is not lashon hara, and calling me an egomaniac and a zealot is. Calling our ads “filth,” Moerdler fails to acknowledge the damage and destruction of BDS to the Jewish state. Even an Israeli court ruled that funding BDS was terrorism. But Mr. Moerdler and his country club buddies are OK with that.

This is a classic case of the powerful trumping the rights of the common man so as to protect their little club. The political and media elites only allow the public discourse to fall within a certain political spectrum. My ads drove them crazy because they fell outside of that spectrum; I was vaulting over their controls and bringing truths to the public that they didn’t want known. They had to move to shut me down.

Clearly, this was a fait accompli. When the vote came in, despite the overwhelming support for free speech, Moerdler’s grin was perfectly evil. One can only imagine the pats on the back over brandy and cigars.

And don’t think for one second that this is a defeat for me. I’ll continue to do the work with more gusto. This is a stunning assault upon our First Amendment rights. Even Board members expressed real concern that the ban would be challenged and overturned. We aren’t the only ones who see the problem with this: Christopher Dunn, associate legal director for the New York Civil Liberties Union, said: “It is unconscionable that you are thinking about barring all political ads from the transit system.”

New York City is the capital of the free world. The world looks to us. What message did we send today? Every city will follow suit. This is a dark day for freedom but have no fear. We will pursue this legally.

Charles G. Moerdler is a partner in the law firm of Stroock & Stroock
& Lavan. He has been with the firm since 1967 and is chair of its Litigation
Department. He was formerly chair of the Executive Committee.

He has been on the editorial board of the New York Law Journal since
1986.

Mr. Moerdler began his law career at Cravath, Swaine & Moore, serving as
an associate from 1956-64.

At the New York Post Company, he served as general counsel from 1988-93 and
as director from 1988-92. He served as chairman of the board of Bank
Austria-Creditanstalt USA from 2000-01.

Active in public service, he served as a member of the New York City Housing
Development Corp. since 1997, member of the New York City Board of Collective
Bargaining since 2000; member of the Departmental Disciplinary Committee,
Appellate Division, First Department from 1998-2004, 2006-2008, and since 2009;
member and now vice chairman of the Committee on Character and Fitness of
Applicants to the Bar of the State of New York, Appellate Division, First
Department, since 1977.

Among his past affiliations, he served as a member of the Dormitory Authority
of New York State from March 2010 through June 2012; was chairman, vice
chairman, or commissioner of the New York Insurance Fund (1978-95); commissioner
of Housing and Buildings, City of New York from (1966-67); member of the Mayor’s
Committee on Judiciary (1994-2001), member, NYC Air Pollution Control Board
(1966-67); and consultant to the Mayor on Housing, Urban Development and Real
Estate (1967-73).

Mr. Moerdler’s civic activities include service as a trustee of St. Barnabas
Hospital since 1986, trustee of Long Island University (1985-91), and member of
the advisory board to the School of International Affairs at Columbia University
(1976-79), and chair of Bronx Community Board 8, then as chair of its land use
committee since 1980.

He was born in Paris, France, and is a Holocaust survivor.

He is a resident of the Bronx.

hmmm, Cravath, Swaine, and Moore. I can’t recall the connections to that law firm that I have read in the past, but they are doozies.

This shows how we can lose to islam. Self-imposed sharia by weak-willed dhimmis who find it safer, easier, to kiss muhammad’s behind, rather than fulfill their duty as good Americans in defense of liberty and human life. Banning political speech is one step closer to outlawing it. We’re going to end up with two different legal systems in this country as does Europe and Britain, one secular, the other religious. Even if the religious side is not codified I can see it becoming a matter of custom. Free speech will become muted by general assent and we will become a defacto islamic state, at least in regard to free speech.

From there it’s only a matter of time, islam’s influence can grow unchecked. Goodbye freedom, hello dark ages.

It seems that most of Pam’s energy is getting wasted in Legal battle & with own people ….Expelling people from job if they criticize or try to make people aware abt danger side of islm,… banning VIsa of people who do not stand with the islamic ideology…Shutting down truth speeches doing mockery & using abusive words…This is how I started looking at Statue of Liberty (???) !!
There should be peaceful protest march against such decision apart from legal battle…

Charles Moerdler talked about Lashon Hara (Hebew for “the bad tongue”) but what he says is Lashon Charah (Hebrew for “tongue of s**t”). He is a disgrace and a dhimmi. I’m appalled by all these so called liberal (so called fellow-) Jewish dhimmis.

If the city bus system were a private company, I might have some sympathy for their decision. But, the MTA is government owned and operated. They cannot pick and choose political speech. The time to decide was at the very beginning when they could have banned all advertising. But, they opened the door to speech by accepting ads at some point. 1A was enacted for exactly this type of event.

Moerdler takes his orders from de blasio who hates Pamela more than anything in his life….. it is very clear what is driving this. And whatever happened to those ads about deblasio you were going to run?…. Two of the most powerful men in the country obama and deblasio hate Pam due to her truth revealing agenda. Pamela you are the best. We need some ads exposing this so called holocaust survivor…

I’m not Jewish but I would like to mention something that will hopefully make you feel better. Jewish people are probably the most adaptable, enduring, intelligent people in history. Even if political ads are banned on buses at least you can be happy knowing that all of your successes far outshines anything that is happening in any Islamic country. Jewish people study, work, contribute, entertain. Muslim people (some, not all) just blow stuff up. (I’m not a racist, I’m just pointing out my observations.)
