(Reuters) – U.S. Secretary of State John Kerry told Republicans who control Congress on Wednesday they would not be able to modify any nuclear agreement struck between the United States and Iran.

Kerry said he responded with “utter disbelief” to an open letter to Iran on Monday signed only by Republican senators that said any deal would only last as long as U.S. President Barack Obama, a Democrat, remains in office.

“When it says that Congress could actually modify the terms of an agreement at any time is flat wrong,” Kerry, who has been negotiating a deal to rein in Iran’s nuclear program in exchange for easing sanctions, told the Senate Foreign Relations Committee. “You don’t have the right to modify an agreement reached executive to executive between leaders of a country.”

But Sen. Rand Paul, a possible Republican presidential candidate in 2016, told Kerry that any deal would need approval by Congress if it affected U.S. sanctions against Iran. Paul accused the Obama administration of trying to bypass Congress.

“The letter was to Iran but it should’ve been cc’ d to the White House because the White House needs to understand that any agreement that removes or changes legislation will have to be passed by us,” the senator said.

The White House has described the letter as “reckless” and “irresponsible,” saying it interfered with efforts by six major powers to negotiate with Iran and prevent it from building a bomb.

The negotiations, which resume in Lausanne, Switzerland, next week, are at a critical juncture as the sides try to meet an end of March target for an interim deal, with a final deal in June.

“We have been clear from the beginning, we are not negotiating, a quote, legally binding plan, we are negotiating a plan that will have in it capacity for enforcement,” Kerry said. “The letter erroneously asserts this is a legally binding plan. It is not. We don’t even have diplomatic relations with Iran.”

“It is incorrect when it says that Congress can actually modify terms of an agreement at any time. That is flat wrong,” Kerry said….

More attention needs to be played to the role of Germany in the outcome of these negotiations and why they have been given a place at the table:

“Germany has been undercutting the sanctions against Iran for years. What’s more, they’ve been accused of providing the Iranians with materials and equipment it needs for building of their nuclear program.”

How is Germany, a country — a people — GUILTY of committing GENOCIDE against the Jews, even permitted to participate in negotiations with a brutal theocratic fascist regime that promotes Holocaust DENIAL, was responsible for the murder of 85 Jews in in a bombing attack in Argentina, and threatens openly to annihilate Israel — the ancient homeland of the Jewish people?

If they “are not negotiating, a quote, legally binding plan,” then what are they doing? If it’s just a non-binding plan, then the Congress can do what ever they want.

Kerry’s statement is an indication that this deal will be much worse the previously thought. It will be some sort of executive order and will irreparably harm the US to the point that it won’t matter what the next president does; it will be too late.

I found it interesting that Kerry basically spilled the beans, and supported his opponents when he said the Republicans have it wrong, its not a binding deal. So, if its not binding, WTF are you doing? I know, giving them a nuke!

Seems to me, with DPRK also on the table, Obama is busy trying to rewind and revisit the cold war, and make sure we lose it.

Kerry is saying Iran is not legally bound to the agreement because obviously the USA and Iran have no common legal forum but any agreement is enforcible, presumably by reinstating sanctions etc. On the other hand he is saying congress is legally bound under American Law to accept Obama’s executive order. He may wrong about the Law but that’s what he’s saying -that Iran is not bound but Congress is bound.

to an America-loathing president and administration, “treaty” means whatever they want it to mean. the founding fathers never anticipated an electorate stupid enough to allow evil men (and in Hillary’s case, sort of women) to get away with changing the meaning of words whenever it suits them. again, a normal response from an opposition party with a huge majority in congress would be to de-fund the state department immediately and let john-boy try to buy his own plane ticket back from wherever he is

While not being able to modify the deal may be true, they Republicans do not have to ratify the deal….Without ratification, when Obama leaves office the deal is null and void.

That letter was not to Iran. It was to the American people who are woefully ignorant on basic civics and to Obama to remind him that he not a king. Kerry, on the other hand, is as much of a dolt as ever.
