Danish magazine for lawyers: Free speech is only democratic as long as it does not provoke violent people

Freedom of speech is the first, last and most essential freedom. The right to hold any view and to express it. It’s the most fundamental tenet of a free society. No ifs, ands, buts or sharia. Western elites are framing sharia restrictions on speech (blasphemy) under the Orwellian guise of tolerance. But what could be more intolerant than silencing the truth?

Freedom of speech includes the freedom not to agree and not to listen. Ayn Rand wrote, “The political function of ‘the right of free speech’ is to protect dissenters and unpopular minorities from forcible suppression.”

Abridging this most crucial freedom so as not to offend savages is civilizational suicide. It is the death knell for the modern enlightenment — in other words, for the West.

Recently the UK Law Society introduced a guide to sharia law. And in Denmark, law professor Trine Baumbach attacks the freedom of speech in the latest issue of Juristen….

The lawyers.

It’s not just Europe. We see similar moves by the American Bar Association (here and here). The Obama administration acts in direct violation of our First Amendment and Bill of Rights: “Congress shall make no law . . . abridging the freedom of speech, or of the press . . . .” It’s just that simple and clear. It’s not just Obama (who declared to the UN in the wake of the 9/11 Benghazi jihad attack, “The future does not belong to those who slander the prophet of Islam”) or the DoJ’s vow to criminalize social postings on Facebook and Twitter that offend Muslims (our protest here and here).

The idea that speech that we don’t like would incite violent people to violence will only increase violence against anyone who says anything that the violent do not like. It’s madness. Freedom of speech and particularly political speech protects all speech, not just ideas that we like, but ideas we don’t like. If not, then who would decide what’s good and what’s forbidden? Obama’s Muslim Brotherhood appointees?

Recently the UK Law Society introduced a guide to sharia law. And in Denmark, law professor Trine Baumbach attacks the freedom of speech in the latest issue of Juristen (The Lawyer). Via 10news.dk, translated from Uriasposten:

Freedom of expression can be seen as an expression of democracy — but only to the extent that free speech is used for the benefit of a democratic society and its citizens. … Freedom of expression is one of the foundations of democratic societies, but only to the extent that freedom of expression is not misused to violate the rights of others or used in a way that society risks being plunged into social unrest and civil peace being threatened.
