REGISTERED sex offender, Ali Jaffari, accused of child-stealing, has had all charges against him dropped, Judge cites “cultural differences”

“Magistrate Ron Saines said if he was hearing the matter, he would have reasonable doubt, citing ‘cultural differences’ as one factor, which would result in the charges being dismissed.” Yes, the Islamic culture allows for such crimes, but since when do the Aussies live under the sharia? How is it possible that this devout pervert is allowed to roam free, in parks with children around?

All charges dropped against registered sex offencer, Karen Matthews, Geelong Advertiser, February 25, 2014 (thanks to Kenneth)

REGISTERED sex offender, Ali Jaffari, accused of attempted child-stealing, has had all charges against him dropped after a Magistrate told prosecutors he would have trouble finding Jaffari guilty.

Magistrate Ron Saines said if he was hearing the matter, he would have reasonable doubt, citing ‘cultural differences’ as one factor, which would result in the charges being dismissed.

Jaffari, 35, an Afghan refugee, was convicted in Geelong Magistrates’ Court on August 22, 2013, of indecently assaulting one boy and attempting to indecently assault another.

He was placed on a two-year Community Corrections Order with 300 hours unpaid community work.

Jaffari appealed the sentence but was found guilty a second time in Geelong County Court last week, when Judge Meryl Sexton re-sentenced him to the same Community Corrections Order and ordered he be placed on the sex offenders register for 15 years.

Jaffari appeared in Geelong court again yesterday, this time charged with child stealing, attempted child stealing and unlawful assault.

Police Prosecutor, Sergeant Brooke Shears said that about 6.30pm on January 27, 2013, a four year old girl went to Bakers Oval, Geelong West, with her father and brother to play cricket.

She said that while the child’s father was throwing the ball to his son in the nets, the little girl was playing with her own bat at the net opening.

Sgt Shears said Jaffari was walking around the oval, when he approached the child, removed the bat from her hand and rested it against a bollard.

“He then grabbed the child’s hand and began to lead her away before she looked up, saw it wasn’t her father, started crying and pulled her hand away,” she said.

“The victim’s father turned, saw what was happening and yelled at Jaffari, “What do you think you’re doing?”

“The victim ran crying to her father and he comforted her while Jaffari walked off around the oval.”

The prosecutor said, that when interviewed, Jaffari told police, ‘For us is not an issue.”

Mr Saines said the prosecution case fell short of criminality and cited cultural differences as a possible mitigating factor.

Sgt Shears however insisted the offending had nothing to do with cultural differences at all.

“He took the child by the hand and led her four or five steps away from her father before the child realised and started crying,” Sgt Shears said.

Defence for Jaffari said that, if the matter proceeded to a contested hearing, there would be no need to hear evidence from the child, her father or brother, that statements would suffice and Mr Saines agreed.

The magistrate then stood the matter down, advising the prosecutor that if he was hearing the matter he would have reasonable doubts in relation to a finding of guilty.

Police later withdrew the charges.

  1. So what is the judge saying, that molestation and child abduction is mainstream Islam? I mean, I know they can be pretty-darn revolting, but is this level of perversion so acceptable in the Islamic world that the judge feels obliged to inject “cultural differences” as a legal consideration? I could be more understanding if the defendant had merely asked the baby-child to marry him, or if he had been caught having sex with some sheep, ya know, the usual stuff. But for god’s sake, kidnapping by a convicted molester? Since when is one’s culture–any culture–a defense for such crimes?

      1. Yeah, I know all about it. That’s Islam 101. But it’s good that you mention it, because it bears repeating.

          1. The demoncrats are everywhere.
There is no such thing as a citizen anymore, all the rules going back to the law of nations are ignored so islam can just walk right in, obama does not enforce his borders, allows armed black panther rebels to guard polling stations, only whites are subject to laws obama and holder choose. obama is going to be the reason for billions of Christian deaths, he is satan’s choice for the nobel piece prize.

      1. If it was my daughter. This back boneless judge would not be on the bench for any longer than it would take me to hunt him down and give him some of my culture.

    1. No defence…I am disgusted by this. You live in a country, you abide by that countries legal laws. Child molestation is the lowest form of abuse inflicted by a supposed adult…I spit on this “human being”

    2. times are really sick barry has teachers in chicago teaching 4 and 5 year olds sexual education this is just the beginning for these incestous hyena’s

    3. It’s stretching the facts to suggest child molestation here. We all like children and maybe he was unaware that you have to be pretty careful when showing affection to children who you do not know and you are a stranger. He didn’t appear to show guilt by hanging around after, though this might have been a ploy. I myself think the goatfucker guilty but under the circumstances… not enough evidence. The father, police and the magistrate acted appropriately.

      1. Then why did the magistrate cite cultural diiferences as reasonable doubt ? …. he should have heard all the wittnesses and evidence and then made a decision instead of prempting his verdict by citing cultural differences bullshit !

  2. Help me out here, if I catch some rag head with his hand on my child and I put a hole through him and sent him to that imaginary paradise, do I get to plead cultural differences?

        1. Hopefully much of this will change when the Abbott Government rescind the 10,000 pieces of legislation – introduced by a feckless Labor Govt.- which hold us all in chains.

      1. muslims..sikhs..hindus are all uncompatible with western nations society…and should be sent back to the deserts..mountains and lands of elephants….all paedos…

    1. Hell no!!!!!! I don’t care who you are ,if you hurt my children or gr. children or gr. grandchildren I will find you and you will face justice.

    2. If only. >~> The whole cultural thing is bullshit too. If you were caught in Afghanistan, the muslim law requires him to be stoned to death. Thanks to the Taliban presence all that has been thrown out of the country. They have decided to make the country theirs, even though they’re foreigners.

  3. when you see a man trying to lead a child away by the hand, and the father is right there, but distracted, then you know that something is seriously wrong. what is wrong with this judge?

  4. If our “governments” won’t protect us from the spawn of Islam, we will have to do it ourselves. If they touch your child, kill them

  5. This is just not right if you come to my country you agree to live by the rules that apply to everyone. The rules do not change because you come from some third world cess pool were life is cheap.

      1. At this point, we need to support each other no matter where these things take place…. We need to help ourselves: Australia, USA, England, etc…..

  6. Who is Magistrate Ron Saines? Where is he from? How did he get into his position? What is his relationship with the Police? How is he related to the Islamic Community in his area? Who are his supporters, donors and what are his political aspirations? Grooming our Legislators and judges for Sharia. Gross.

      1. Yes, yes, but my point was that the Geelong Advertiser didn’t convey much investigative information. I’m interested in his history, or perhaps “ties” to the Islamic “culture” mentioned as an excuse. Thank you though for your response.

    1. My self, all that would not matter. He would have his last session on the bench. His bench would be about 6 ft under.

    2. It’s already happening in UK and Canada… why not Australia, too? Coming soon to a US courtroom near you.

  7. OMG I dont know who this judge is or how he got on the bench but he is a wack job. The prosecution must re appeal the case to a higher court. They must, or there is no more right or wrong in this country. There is no more justice. There is no hope for the children of this generation.. If this man is not put away this country is doomed I don’t care what his background is, He is a pedophile judge!!!!!!!!!!!!

  8. I would tend to believe that the magistrate would be a closet pedophile, and shouldnt be allowed to sit in a court of law..I hope the police appeal this judgement..atleast for the childs sake…I,m like Danny Ray…I would shoot him and claim cultural differences….I dont like them.

    1. A long time ago I read about a large building in New York City, where all the apartments were stocked with prepubescent children addicted (forcefully) to heroin, they were abused by pedophiles until they reached puberty, after puberty they were thrown onto the streets addicted and helpless, although some became very lethal 10 yr old assassins, The Article stated that the clientele of that building were Judges, lawyers, doctors and probably university professors, the most powerful people running most of our economy are perverts, These people have destroyed the work of hundreds of millions of Christians and are just as evil as the the hamheads, even worse because they were not forced like the muslims, still no excuse for doing such vile acts.

  9. how did that magistrate get his job? was his degree the prize in a box of cracker jax? he should be relieved of duty . was he high that day? i seriously just can not wrap my mind around this judge who has apparently lost his common sense. did he bump his head?

  10. This happened in AUSTRALIA. I am posting this because there seems to be a lack of reading comprehension going on here.

  11. It should be noted that this heinous act took place in Australia and it seems to be the way of the courts of late to either put it down to cultural difference or it might ruin their lives/career later on. My question is what do they think it does to the child/person being attacked . In the case of this type of act it shouldn’t matter his culture he is living in Australia not a middle eastern country. The do-gooders and the legal system/politicians wonder why there is so much conflict between cultures/races when this sort of crime gets brushed under the carpet
    .

  12. When faced with the cultural differences argument over the practice of suttee, Sir Charles Napier said:

“You say that it is your custom to burn widows. Very well. We also have a custom: When men burn a woman alive, we tie a rope around their necks, and we hang them. Build your funeral pyre; beside it, my carpenters will build a gallows. You may follow your custom. And then we will follow ours.”

  13. Two stories one on top of another coming about Australia makes me wonder if they are really true or just a fixture of a writers fanciful imagination?

  14. this muslim bastard is a clear danger to children why is he not locked up or even sent back home to whatever islamic hell hole he came from its fucking shocking the way our courts and governments are bending over for these muslim cunts!

  15. Okay Corinna. So it happened in Australia. We understand. I kinda feel the geographical whereabouts not so important. What is important is us putting up (and even supporting) muslim filth.

  16. He already abused two boys, got off and then was caught trying to take a young girl,a and all charges dropped?????????INSANE!!!!!!!

  17. It’s time for vigilantes to take care of these a**hats…because it’s increasingly obvious that our established law enforcement establishments are failing us all.

  18. If it was my daughter. This man would be in fear every breath he was allowed to take. The planet would not be big enough for both of us.

  19. These people live in our country. If you want to observe your counties disgusting behaviour…then go back to where you came from. This behaviour is not tolerated in Australia. Anyone hurting a child, regardless of race, religious beliefs or cultural differences needs to be jailed for life. You chose to be here, we didn’t ask you to live here….There is no excuse for what you did. You are a menace to society.

  20. When you go to Rome do as the Romans do , but this particular magistrate says , When you come to Australia do as you please ! Our courts really are a pathetic … who’s really looking out for our kids .. not this magistrate ..

  21. Someone needs to put the fear of God into that Judge
They can start by tossing a brick through his windshield

Then he can complain to the police.
The police will then charge the “Brick”.
Then another Judge will stand the matter down, telling the prosecutor that if he was hearing the matter he would have reasonable doubts in relation to a finding of
    guilty.

    What goes around comes around.
Especially with judges who are lenient with Child abductors.
That type of Judge has no friends in a police force.

  22. Cultural issue? So it is ok to try and abduct a child? What planet if this idiot Judge living on? What if the child had been his – what would his reaction have been then? “Oh-just a cultural mistake”.

  23. Derryn Hinch has been most vocal about naming and shaming paedophiles – yet he was jailed for speaking out about it and for naming that foul beast who was let out on parole and murdered Jill Meagher. We MUST be able to speak freely – we live in a Democracy – or so I thought.

  24. I don’t understand this at all ,this is the USA and here our children are suppose to be safe and the law is suppose to protect our children for what happenes to them in this country. If this happens to the Presidents children would the same sentence happen???? I didn’t think this country was made up of who you were or how much money you had to buy your way out!!!!!
So our children don’t mean a damn in this country to some judges. I feel so sorry for all you people that only think of the almighty buck. YOU LOOSE!!!!

  25. This Magistrate is very typical of what’s happening in Australia at the moment, handing out GROSSLY INADEQUATE sentences for all violent and sex offenders.
